EU-US Privacy Shield
The following terms apply only to the collection, use, and retention of personal data transferred from the European Union.
ADTRAN recognizes that the European Union ("EU") has adopted the EU General Data Protection Regulation ("GDPR") which requires "adequate protection" for the transfer of personally identifiable information about individuals in the EU to ADTRAN operations in the US.
To provide adequate protection for certain personally identifiable information received by ADTRAN in the US, ADTRAN complies with the EU-U.S. Privacy Shield Framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal information transferred from the European Union to the United States. ADTRAN has certified to the Department of Commerce that it adheres to the Privacy Shield Principles of Notice, Choice, Accountability for Onward Transfer, Security, Data Integrity and Purpose Limitation, Access, and Recourse, Enforcement, and Liability. In addition, ADTRAN is subject to the investigatory and enforcement powers of the Federal Trade Commission (FTC). If there is any conflict between the terms in this privacy policy and the Privacy Shield Principles, the Privacy Shield Principles shall govern. Onward Transfer; Data Transfers to Third Parties. We may share Personal Data with third-party agents or service providers who perform functions on our behalf for the purpose of: operating our business; delivering, improving, and customizing our websites, products, and services; sending marketing and other communications related to our business; and for other legitimate purposes permitted by applicable law or otherwise with your consent. EU individuals with inquiries or complaints regarding our Privacy Shield policy should first contact ADTRAN at: [email protected] We will investigate and attempt to resolve any complaints or disputes regarding the use or disclosure of your Personal Data within 45 days of receiving your complaint. ADTRAN has further committed to cooperate with the panel established by the EU data protection authorities (DPAs) with regard to unresolved Privacy Shield complaints concerning Personal Data transferred from the EU. If you do not receive timely acknowledgment of your complaint from us, or if we have not addressed your complaint to your satisfaction, please contact the EU DPAs for more information and assistance or to file a complaint.
